Sammanfattning
This thesis examines how Swedish municipalities apply conservation provisions in detailed development plans and whether these provisions comply with the requirements of the Swedish Planning and Building Act. The study focuses on preservation regulations intended to protect cultural heritage values, including protection provisions, demolition prohibition and caution provisions. It also investigates how municipalities address compensation issues in planning descriptions when such regulations restrict freehold. The research is based on a review of detailed development plans adopted between 2020 and 2025 in selected Swedish municipalities. The plans were reviewed with regard to legal support, clarity of formulation and the handling of compensation claims. The assessment criteria were primarily based on legislation, case law and guidelines issued by the Swedish National Board of Housing, Building and Planning. The study also examined whether municipalities use caution provisions in detailed development plans that impose such far-reaching requirements that they should instead be classified as protection provisions among the examined detailed development plans. The results indicate that deficiencies in the formulation of conservation provisions remain common. Several plans contain inadequate conservation provisions that risk creating legal uncertainty for property owners. The study further shows that municipalities often handle compensation issues inconsistently, and that discussions regarding cumulative damage and compensation liability are frequently incomplete or absent in planning descriptions. The thesis concludes that many municipalities still formulate conservation provisions in ways that risk creating legal uncertainty and inconsistent application in practice. Therefore, there is a continued need for clearer and more legally secure formulations of conservation provisions in detailed development plans. The study therefore indicates a need for clearer guidance and more correct and consistent application of the Planning and Building Act when conservation provisions are incorporated in detailed development plans.
