Sammanfattning

The purpose of this study was to examine how gender norms and expectations about masculinity might influence custody investigations and court rulings. The study aimed specifically to examine how those norms shaped the social services risk assessments and court rulings, when there is documentation of violence committed by the father. Through this, how patriarchal norms may affect children's safety and the view on fatherhood is highlighted. In this study I used custody investigations and court rulings regarding custody trials from different courts around Sweden. This study used two theories, Yvonne Hirdmans theory about genderpower and Judith Butlers theory about gender and performativity. The result was analyzed through discourse analysis using Faircloughs three-dimensional model. The result shows that social services, through risk assessments, and courts, use gender norms and expectations about masculinity to maintain violent fathers as prominent and essential for childrens development, hidden behind the presumption of childrens rights to both parents. Based on norms, expectations, power relations and hierarchy, social authorities make judgements that risk placing women and children in dangerous situations where violence is present.
